If you wish to become a customer or active user of our webshop, please read our General Terms and Conditions thoroughly and use our services only if you agree with all its provisions and accept it as binding.

General Terms and Conditions of Contract and Use

Under the present terms and conditions, the contract will not be filed, it will be concluded exclusively in an electronic form, it cannot be retrieved later, and it does not refer to any code of conduct.

Our webshop can serve only those who are 18 years of age or older. Accordingly, Customers are required to make a declaration regarding their age during the order process.

2. Scope of available products and services

Products displayed in the webshop can be ordered from the webshop via email and are delivered by courier service.

The product’s volume and price can be found at the product description. Prices include legally prescribed VAT but no delivery charges.  No additional costs will be charged for packaging.

3. Order processing

Orders are confirmed within 48 hours via phone or email. The general period for order fulfilment is within 2-3 days of the date of confirmation. In case of any obstacles, notifications will be sent via phone or email.

In case we are unable to contact Customer via phone within 3 working days of the order date, the order will be considered invalid.

Images displayed on the products’ data sheet are for illustration purpose only and may differ from the actual product.

4. How to order

  1. Select the wine(s) you wish to order and then set the quantity of bottles to be ordered for each product.
  2. If you require further information regarding a specific wine, click on the wine’s name. The computer will save the wines in your cart.
  3. Check the type and quantity of products to be ordered and then select delivery method and gift wrapping.
  4. If your delivery and billing information are not the same, please, enter your delivery information. After checking the details of the order, accepting the General Terms and Conditions, and declaring that you are over 18 years of age, click on the “place order” button.
  5. After your order is placed, you will receive a confirmation email. You may not receive the confirmation email if a wrong email address has been provided or if the storage space of your email account is full. In case of failure to receive the confirmation, please contact our customer service.

 

5. Payment for the ordered products / delivery

The purchase price of the ordered products shall be paid in advance via wire transfer. The invoice and information regarding the right of withdrawal and its exercise are included in the package.

Please inspect the package upon delivery in the presence of the courier. If any damage is detected, ask the courier to draw up a protocol of the damage. In this case, the delivery should not be accepted. Subsequent complaints will not be accepted without a protocol.

 

 

6. Delivery information

General period of performance: within 2-3 but no more than 5 working days of the confirmation of the order.

Orders are delivered via courier service on working days between 8 a.m. and 5 p.m. If you are not at home during this period, it is recommended to set your work address as delivery address, if possible. The courier service will attempt delivery twice. The costs of unsuccessful deliveries shall be borne by Customer.

7. Delivery charges

The delivery fee is HUF 2,200. Operator does not offer Cash on Delivery payment method. Orders over HUF 20,000 are delivered free of charge.

The above charges are payable only once, even if the order needs to be delivered in multiple packages or if it cannot be delivered all at once. (Delivery charges are for deliveries within the territory of Hungary. Operator does not offer international delivery.)

8. Notification regarding the reception of packages

The courier will attempt delivery twice to the provided delivery address. In case of unsuccessful, returned deliveries, the costs of returning the products shall be borne by Customer. Such packages will only be resent after the payment of the packages’ price in advance.

9. Replacement guarantee

If a package proves to be damaged after its opening in the presence of the courier, and if the damage occurred prior to the receipt of the product, Operator offers a 3-day replacement possibility. In this case, such damages can be proved with the protocol drawn up by the courier.

Grounds for exclusion of replacement guarantee

Please verify the integrity of the package in the presence of the courier. If any damage is detected, ask the courier to draw up a protocol of the damage, and refuse the acceptance of the package. Subsequent complaints regarding the packages’ physical damages will not be accepted without a protocol.

Operator will not be able to replace the product in the following cases:

  • in case of tartrate deposits in the bottle,
  • if a fault can be observed in the wine’s colour, but the bottle is open,
  • if Customer complains about external damages after signing the document certifying the receipt of an undamaged package.

10. Right of withdrawal

In accordance with the provisions of Hungarian Government Decree No. 45/2014 (II.26.) on the detailed rules of contracts concluded between consumers and businesses, consumer has the right to withdraw from the contract without giving reasons within 14 working days of the product’s receipt, and to return the ordered product.

Accordingly, Customers have the right to withdraw from the purchase after placing the order, but before the delivery. Customers may indicate their wish to exercise the right of withdrawal by sending a mail to the email address: or by calling the phone number: +36204291120.  In this case, the Customer will not be charged any costs.

In case of exercising the right of withdrawal after the delivery of the order, the consumer will not be charged any costs other than the costs of the return of the product. The right of withdrawal may be exercised only in the case of unopened wines.

Excerpt from the Hungarian Government Decree No. 45/2014 (II. 26.):

Article 20(1) In case of off-premises and distance contracts, consumer shall have the right of withdrawal without giving reasons within the time limit set out in paragraph 2. In case of off-premises and distance contracts for services where the contract performance commences after making a declaration pursuant to Articles 13 or 19, consumer shall have the right of cancellation without giving reasons within the time limit set out in paragraph 2.

(2) Consumers may exercise their right of withdrawal or cancellation set out in paragraph 1 within 14 days of

a) in case of contracts for the sale and purchase of products, the date of

aa) the receipt of the product,

ab) in case of the sale and purchase of multiple products where certain products are delivered at different times, the receipt of the last supplied product,

ac) in case of a product consisting of several lots or pieces, the receipt of the last supplied lot or piece,

ad) in case of a product that has to be supplied regularly over a defined period of time, the receipt of the first supply

by the consumer or by a third person different from the carrier specified by the consumer;

b) in case of contracts for services, of the date of the conclusion of the contract.

(3) The provisions set out in paragraph 2(a) do not affect consumers’ right to exercise their right of withdrawal specified in this Article within the period between the date of the contract’s conclusion and the date of the product’s receipt.

11. How to exercise the right of withdrawal

You can notify us of your intention to exercise the right of withdrawal in writing via the provided contact details or via phone. In case of written notification by mail, the date of posting and in case of notification via phone, the date of the phone call will be taken into account. It is advised to send notifications by mail as registered mail, so that the posting date can be verified.

Return the ordered product in an unopened state to Operator’s address via mail or courier service. Please note that the costs of the product’s return shall be borne by Customer. Operator does not accept packages sent with unpaid postage (addressee pays service, C.O.D.).

Please pay special attention to the intactness of the product. Customer shall be liable for any damages arising therefrom.

After the receipt of the returned package, Operator will record the opening of the package and the inspection of the returned product in order to avoid any future misunderstandings (regarding, for example, the product’s intactness or completeness).

Within 14 days of the receipt of the returned product, Customer will be reimbursed for the product’s purchase price via wire transfer to the bank account provided by Customer (Based on the agreement of Customer and Operator, such reimbursements may also be paid by postal order.)

12. Data handling

Operator handles all personal data provided during the use of the webshop as confidential. Such data will not be made available to further parties with the exception of when such data is necessary for the performance of Operator’s subcontractors (for example data required by the courier service for the delivery of the order).

During browsing the webshop, technical information is recorded for statistical purposes (IP address, length of stay on the site, etc.). These data are transferred to the authorities only in legally justified and duly substantiated cases.

Patricius Borház Kft. will use the data registered during the order process exclusively for the fulfilment of the order. The data of invoices created by certain IT systems for orders submitted via the webshop with data registered during the order submission will be recorded and stored for the period specified in the Hungarian Act on Accounting.

 

13. Complaint management

Complaints shall be recorded in a protocol by Operator and shall be preserved – together with the provided response – at the place specified in the Operator’s details for five years of the date of the complaint’s registration. Operator shall investigate and provide substantial response to the received complaint within 30 days of the complaint’s registration. For negative responses to complaints, Operator shall provide written reasons. Legal disputes arising from contracts concluded with Operator shall be primarily settled amicably via the agreement of the parties or before the consumer protection authority with jurisdiction at the consumer’s domicile. If these methods prove to be ineffective, the dispute may be settled by taking the judicial route.

Complaints may be made to the following Authority:

In case consumers notice a breach of their consumer rights, they have the right to make a complaint to the consumer protection authority with jurisdiction at the consumers’ domicile. After the complaints’ evaluation, the authority decides on launching the consumer protection procedure. Tasks of the consumer protection authority of the first instance are performed by the district office with jurisdiction at the consumers’ domicile. Questions not regulated in these General Terms and Conditions shall be governed by the provisions of the Hungarian Civil Code, Hungarian Government Decree No. 45/2014 (II.26.), and the Hungarian Act CVIII of 2001 on e-commerce and certain issues regarding Information Society services.
